When an individual sustains a severe injury due to a product that was incorrectly marketed, the injured consumer may be entitled to monetary compensation from the manufacturer of the product in a product liability lawsuit. Marketing defect product liability c may arise when a product is incorrectly labeled or not labeled at all, and because of this lack of proper labeling, the consumer using it may sustain a severe injury or even death.
If a product is labeled as safe for anyone to use, or for specific consumers, such as pregnant women, children, or consumers with diabetes, and that product actually causes severe harm to consumers, the product may have been marketing incorrectly. In some cases, what may seem to be a marketing defect may also be a manufacturing defect as well. This may happen if a product was incorrectly put in the wrong packaging, due to manufacturer mistake.
