Did you know? Garnishment of disability payments by anyone other than the federal government is a violation of the Social Security Act. Section 207 of the SSA explicitly states that the right to future social security payments is not transferable or assignable. As long as they are clearly identified as Social Security payments, moneys paid or payable are not “subject to execution, levy, attachment, garnishment, or other legal process, or to the operation of any bankruptcy or insolvency law.”
