Her complaints included his diaper not being changed, his dentures not being cleaned, he was not shaved or bathed on a regular basis, and despite his inability to feed himself, the nursing home staff would refuse to help him eat. Evans stated she complained to the nursing home management several times, but nothing changed. Finally, the Virginia Medicaid Fraud office requested permission to have the FBI put a hidden surveillance camera in Jack Evan’s room. The content of the tapes resulted in 11 employees being arrested and charged with everything from neglect and forgery to assault and battery. The treatment Jack Evans received was even worse than Mark Kay Evans suspected. One of the male nurses charged in the incident was caught holding a pillow over Jack Evan’s face, and another nurse being charged was videotaped laughing while she threw popcorn at Mr. Evans. Mary Kay Evans has since filed a $10 million lawsuit against the nursing home, its holding company, and all the employees involved in her husband’s care. The Potomac Nursing Home released a statement that they firmly believe that Jack Evans got good care while he stayed at their facility. They also assert that most of the allegations against their employees are unfounded, and the small handful of employees that did act inappropriately has been fired. Despite their confident statement released to the press, Mary Kay Evans has video evidence that her lawyers will be able to show a jury if it goes to a court trial. This videotapes clearly showing multiple employees neglecting and abusing her husband. Although a good nursing home may occasional have an issue with an isolated bad employee, having 11 or more bad employees is a reflection on the company as a whole and the managers responsible for overseeing the day-to-day operations.
