For conventional marriages, Arizona is a no-fault state. This means that those wishing to file for divorce can do so by simply saying that the marriage is “irretrievably broken.” The only other condition is that either party must have lived in Arizona for at least 90 days before beginning the divorce process.

Division of Assets in Arizona
Arizona is a state that follows community property laws, which translates to all assets obtained through the marriage becomes community property is separated and distributed equally and fairly by the courts, provided the parties cannot reach an out-of-court agreement. Any valuable that is the exclusive and separate possession of one party will remain in that party’s ownership. Other factors can influence the laws that govern Arizona property division, including excessive purchases or unusual spending, actual judgments and damages from activity that was determined to be criminal against a child or other spouse, and fraudulent and destructive disposition or concealment of joint property.
